Legal question
If a soccer club makes a bunch of promises to players and sends emails to players with these promises to get them to sign up and they do not fullfill them can any legal action be taken against the club?

What would you hope to get out of it? Your fees refunded? Seems like a lot of work, may be best to just move on. I can tell you of all the years of different coaches and clubs (between my 2 BB's who are 4 years apart), I have seen plenty of crap coaches who promised all the glory and didn't deliver. Best to just move on in my opinion.

After reading this post, I actually spent a little time thinking about it. In actuality, this could be a question on a law school exam. There are so many legal issues involved.
For instance, if you are suing on behalf of your child, what are his damage? He does not have any monetary damages. I have seen my share of coaches inflict emotional distress on a child, but I am not sure it reaches the level needed for a claim for intentional infliction of emotional distress.
In contrast, if you are suing on your own behalf, it is probably a contract claim. Thus, your claim would have to be based on the club failing to do something that it promised to do within the four corners of the agreement, and I doubt the alleged promises that were broken are in the agreement. In fact, I looked at an old agreement (for a big club) and noticed that it had a provision in which the parents agreed not to sue the club unless gross negligence or willful misconduct was involved.
I do not know if the provision agreeing not to sue is allowed under Texas law, but I am willing to research it for $400 an hour. I am guessing it will only take me about ten hours to do some extremely thorough research, which leads to the real issue. Do you really want to spend the time, money, and anguish involved?

You are probably right. Waste of money and time to pursue. The club made promises of certain services and opportunities for the teams and then never delivered on them. Had nothing to do with individual playing time or anything. Live and learn. Just an extremely dishonest and greedy soccer program.

Amkkba, for the record (and to cover myself), please do not make any legal decisions based on my post. It was not intended to provide any legal advice. I am just some random dude that watches a lot of Ally McBeal reruns. One of the great things about the US is that you can generally bring a lawsuit against anyone for any reason.
